Two-Step Partner Visa Process
Temporary Partner Visa – Subclass 820
This is the first stage of the partner visa process.
- Allows you to live in Australia while your permanent visa is being assessed
- Granted while you are in Australia
- After holding this visa for at least two years, you may be assessed for the permanent stage
Permanent Partner Visa – Subclass 801
This is the second stage, providing permanent residency.
- Allows you to live, work, and stay in Australia permanently
- Granted once the Department is satisfied that the relationship is genuine and ongoing

Eligibility Criteria
Subclass 820 – Temporary Partner Visa
Applicants must:
- Be 18 years or older
- Be in Australia at the time of application and visa grant
- Have an eligible sponsor (spouse or de facto partner)
- Meet health and character requirements
- Have repaid, or arranged repayment of, any Australian Government debts
Special Note:
If the sponsoring partner is under 18, a parent or guardian who is an Australian citizen, permanent resident, or eligible New Zealand citizen may sponsor the applicant.
Subclass 801 – Permanent Partner Visa
Applicants must:
- Hold a Temporary Partner Visa (Subclass 820)
- Be in a genuine and ongoing relationship with the sponsor
- Have complied with all Subclass 820 visa conditions
- Have no visa cancellations or refusals during the 820 period
- Meet health and character requirements (where applicable)
Sponsorship Limitations
A sponsorship may be refused if:
- The sponsor was granted a Partner Visa or Prospective Marriage Visa (Subclass 300) within the last 5 years
- The sponsor has already sponsored two people for a partner visa
- The sponsor has sponsored another partner within the last 5 years
Exceptions to Sponsorship Limitations
Exceptions may apply if:
- A previous partner has passed away or the relationship ended due to abandonment
- The sponsor has lived with the current partner for more than two years
- The sponsor or applicant has dependent children
Sponsorship Obligations
As a sponsor, you may be required to:
- Provide accommodation
- Offer financial support for living expenses
- Assist with English language courses (if required)
- Support childcare needs (if applicable)
Including Family Members
Applicants may include:
- Dependent children
- Stepchildren
Included family members receive the same visa rights and conditions as the primary applicant.
Health & Character Requirements
- Health Examinations: Must generally be completed within 12 months of application
- Police Certificates: Required for applicants aged 16 or older for countries lived in for 12 months or more over the last 10 years
