What is Condition 8503?
Condition 8503 (No Further Stay) is a visa condition that prevents the visa holder from applying for any other substantive visa while in Australia, except for a Protection Visa.
Importantly, this restriction can apply even after the visa has expired, unless the condition is formally waived by the Department of Home Affairs.
When Can Conditio n 8503 Be Waived?
Condition 8503 may be waived only if compelling and compassionate circumstances have arisen after the visa was granted.
The applicant must show that the circumstances:
- Were beyond their control, and
- Resulted in a major change to their situation

Previous Waiver Refused?
If a previous Condition 8503 waiver request was refused, any new request must be based on substantially different circumstances.
Re-submitting the same or similar reasons will generally result in another refusal.
